North Elba OKs 3-month STR moratorium extension

Village of Lake Placid considers partial extension

LAKE PLACID — The town of North Elba has extended its moratorium on the issuance of new short-term vacation rental permits through mid-December. The village of Lake Placid also intends to extend its STR moratorium, but only for residential areas in the village.

The town and village’s moratoriums began in March. The town council voted on Tuesday to extend its STR moratorium for three months. The moratorium, which was originally set to end on Sept. 10, was extended as the town council works through administrative processes — talks with the town attorney, a public hearing and seeking county approval — that are required before it can implement new STR regulations. The town’s moratorium will now end on Dec. 10, unless the council votes to extend it a second time.

The town held a public hearing on the proposed extension of its STR moratorium on Tuesday night, Sept. 6, ahead of the council’s regular board meeting. No one from the public spoke at the hearing, according to town officials.

The town is getting close to finalizing the language of its new STR regulations, which would still need to go through a public hearing at the town level before becoming law. The town submitted a draft of its STR regulations — available at tinyurl.com/4zhub6rv — and held an informal public hearing about the draft at the end of August.

The town and village held a series of special meetings to discuss STRs over the summer. North Elba town Supervisor Derek Doty said on Tuesday that the town has tentatively scheduled one more special meeting to discuss STRs at 3:30 p.m. on Sept. 13. However, Doty said the town may not need to have the meeting; the town council plans to talk to its attorney about appropriate legal language for the new STR regulations, and Doty said that the town might not need another STR meeting if the town attorney says the regulations look good. At that point, the town would only need to schedule and hold a public hearing before the STR regulations could become law.

Partial extension?

The village’s current STR moratorium is set to end on Sept. 30. The village wants to extend the moratorium through Dec. 31, but only for residential areas in the village — that includes areas zoned as town residential, village residential and South Lake residential districts in the village. The village does not want to extend the moratorium for areas zoned as the village center or for properties in the Main Street corridor. Village officials said they aren’t planning any major changes to STR regulations in those areas, and they feel the moratorium should be lifted there.

The village is required to hold a public hearing before the proposed partial extension can go into effect. The village will hold a public hearing for the partial moratorium extension at 4:30 p.m. on Sept. 19 at the North Elba Town Hall, ahead of the village’s regular board meeting at 5 p.m.

The village hasn’t released a draft of potential STR regulations yet, though the board has held multiple meetings to discuss new regulations. People can watch the village’s STR meetings on the village’s YouTube channel at tinyurl.com/5d4wmasu.

The village is holding a workshop session at 3:30 p.m. on Sept. 13, and village Mayor Art Devlin said the board plans to further discuss its STR recommendations and schedule a future town hall meeting — where people could vocalize their thoughts about the village’s STR regulations — at the session.
