Village police charge pair with robbery

LAKE PLACID - A pair of Essex County residents face felony robbery and conspiracy charges after they allegedly robbed and attempted to assault a man they knew.

Village police arrested Joshua A. Stone, 31, of Elizabethtown and Stephanie M. Colby, 32, of Westport on Sept. 7 at a parking lot outside a restaurant on Saranac Avenue. Police declined to identify the restaurant.

Police said Stone and Colby conspired to fraudulently steal $350 in cash from an unnamed victim before forcibly taking the money from the man, who police say had a previous relationship with them both.

"The investigation basically revealed that the victim, in an attempt not to have his money stolen from him, was assaulted," said Lake Placid Assistant Police Chief Chuck Dobson. "Or at least the defendants attempted to assault him."

Police added that the victim had minor injuries and refused medical attention after the incident.

"Both defendants struck the victim with their fists and kicked the victim," Dobson said.

Dobson added that police don't believe any weapons were involved in the incident.

Speaking Sept. 11, Dobson further described the three people involved as "associates." Dobson also declined to comment on whether police believe the robbery was related to drug activity. Police previously said at the time of his arrest Stone was found to be in possession of a syringe, a misdemeanor he was also charged with.

The arrests of Stone and Colby took place at the scene of the alleged crime at 3:23 p.m. Sept. 7, a little more than an hour after police say the alleged incident occurred. Police said they interviewed several witnesses who were in the area at the time of the alleged incident.

Police also charged Colby with four driving-related infractions after they say their investigation determined she had been operating her vehicle without proper insurance, registration, inspection or license plates.

Stone and Colby were charged with second-degree robbery, a felony that carries a mandatory minimum sentence of three-and-a-half years and a maximum of 15 years in state prison.

Stone and Colby were also charged with fourth-degree conspiracy, a felony that carries an additional sentence of up to four years in prison, five years of probation and/or a substantial fine.

They were also each charged with third-degree attempted assault, a misdemeanor.

Stone and Colby were arraigned in town of North Elba court Sept. 7 because Lake Placid's village court was unavailable, Dobson said. They were subsequently sent to Essex County Jail in Lewis. Colby's bail was set at $1,000 cash or $5,000 bail bond. Stone's bail was set at $500 cash.

Colby was bailed out Sept. 8, and Stone was bailed out on Sept. 9. They are scheduled to return to court for an initial appearance this week.
